Foreign investment registration for real estate in Colombia should be planned before you transfer the deposit. The payment route, buyer’s identity, purchase documents and investment record need to describe the same transaction.
For buyers from the United States, Canada, the United Kingdom and other countries, moving the money is only one part of the purchase. How the funds enter Colombia can affect exchange compliance, future repatriation and an investor visa application.
This guide explains how to prepare the transfer, determine the registration route and verify the resulting record.
Quick answer: When a qualifying foreign real estate investment is funded through Colombia’s foreign exchange market, supplying the correct investment information allows the exchange declaration to serve as the investment registration. Eligible transactions without currency channeling use a different registration procedure. A wire receipt alone does not establish that either procedure was completed correctly. [1]
Who Must Register a Foreign Real Estate Investment in Colombia?
Colombian real estate acquired by a person classified as a nonresident for foreign exchange purposes can constitute foreign direct investment. Qualifying fiduciary investments may also fall within the regime. [2]
Nationality alone does not determine the answer.
For foreign individuals, exchange residence generally arises after spending more than 183 calendar days in Colombia within 365 consecutive calendar days, counting arrival and departure days. A Colombian company with its principal domicile in Colombia is generally an exchange resident. [3]
A foreign passport, Colombian visa or overseas bank account does not independently establish nonresident status. Immigration residence, tax residence and foreign exchange residence require separate analysis.
Review the buyer’s status at the time of the investment, especially when deposits and closing occur months apart.
Property Registration and Investment Registration Are Different
A Colombian property purchase involves separate records:
| Record | What it establishes |
|---|---|
| Property registry | The registered legal position concerning the property, including ownership |
| Foreign investment record | The reported international investment for exchange purposes |
| Bank and payment records | The movement and application of the money |
Registration of the deed with the Oficina de Registro de Instrumentos Públicos is part of transferring real estate ownership. Registering an investment with the Banco de la República does not replace that process. [4]
The investment record also does not certify that the property has clean title.

Automatic vs. Direct Foreign Investment Registration
The correct route depends on how the investment is funded and acquired.
| Situation | General registration route |
|---|---|
| Qualifying investment made with foreign currency properly channeled through an authorized foreign exchange intermediary | Automatic registration through the investment exchange declaration |
| Eligible investment completed without required currency channeling | Direct registration through the Banco de la República’s Foreign Exchange Information System |
| Currency that should have been channeled correctly but was not | Transaction review and the appropriate corrective procedure |
An authorized foreign exchange intermediary is known as an Intermediario del Mercado Cambiario, or IMC. Compensation accounts provide another regulated channel where applicable.
The Banco de la República confirms that a correctly channeled investment generally does not require a second registration filing. It also states that direct registration cannot be used simply because a transaction failed to follow a mandatory channel. [5]

How to Transfer Funds to Buy Property in Colombia
1. Decide Who Will Legally Buy the Property
Confirm whether the purchaser will be:
- You personally.
- You and another buyer.
- A foreign company.
- A Colombian SAS.
- A fiduciary structure.
The person sending the money, the purchaser and the investor recorded in the transaction must be reconciled.
If a Colombian SAS will purchase the apartment, first determine whether the shareholder’s funding is a capital contribution or a loan. Debt is not treated as foreign equity investment merely because the company uses it to buy real estate. [6]
Company ownership and personal ownership can also have different tax, succession and immigration consequences.
2. Coordinate the Contract and Payment Schedule
Your promesa de compraventa should identify the price, deposit, payment dates, authorized recipients and currency arrangements.
Allow enough time for banking review before a contractual payment becomes due. Address what happens if a transfer is delayed, returned or credited short because of fees.
Prepare a separate budget for the property price, closing expenses, professional fees, furnishing and other costs. Do not assume every amount transferred belongs in the same investment category.
3. Confirm the Receiving Arrangement Before Sending Money
Ask the receiving bank or intermediary to confirm:
- Whether it can process the proposed real estate investment.
- Which account should receive the funds.
- Who will supply and transmit the investment information.
- How the buyer will be identified as the investor.
- Which investment destination and exchange concept apply.
- What evidence will be available afterward.
Where payment goes directly to the seller or through a fiduciary structure, ask how the investor’s identity and the payment’s purpose will be preserved.
A competitive exchange rate is only one consideration. The provider must also support the legal and reporting requirements of the transaction.
4. Prepare the Documents Requested for Banking Review
Depending on the intermediary and transaction, prepare:
- Passport or other accepted identification.
- Residence and contact information.
- Purchase agreement and payment schedule.
- Property and seller information.
- Evidence of the source of funds.
- Statements from the sending account.
- Corporate and beneficial ownership documents, if relevant.
- A power of attorney where a representative acts.
These are preparation recommendations, not a universal statutory document list. Banking compliance requirements and investment reporting requirements serve different purposes.
Confirm the institution’s requirements before committing to a closing date.
5. Agree on the Exchange and Payment Mechanics
The contract and banking instructions should answer:
- Is the purchase price fixed in Colombian pesos?
- When will the currency be converted?
- What exchange rate will apply?
- Who pays sending, correspondent and receiving fees?
- How many pesos must actually reach the seller?
- Who covers a payment shortfall?
Colombia’s market exchange rate is negotiated. The published TRM should not be assumed to be the rate your provider must offer. [3]
For a fixed peso purchase price, calculate the foreign currency required using the actual quote and applicable charges.
6. Supply the Correct Investment Information
Before conversion and reporting, review the investor’s name, accepted identification, investment destination, transaction value, currency and applicable exchange concept with the intermediary.
The investor and the account beneficiary are not interchangeable concepts. A seller receiving payment should not be reported as the foreign investor merely because the funds reach the seller’s account.
The exchange declaration must reflect the operation actually being performed. Keep the declaration or transaction information supplied by the intermediary alongside the transfer confirmation. [6]
7. Reconcile Each Payment With the Purchase
For every installment, retain a clear connection between:
- The transfer.
- The conversion.
- The exchange declaration.
- The amount received.
- The contractual payment it satisfies.
Request payment acknowledgment from the authorized recipient.
If the property has parking spaces or storage units with separate titles, keep the purchase documents and allocation of the price clear. If one transfer covers several purchases or expenses, prepare a reconciliation rather than treating the entire amount as one unexplained property payment.
8. Verify the Investment Extract
Obtain the extracto de inversiones through the Banco de la República’s Sistema de Información Cambiaria.
Check the investor’s identity, destination, transaction dates, reference numbers, intermediary and reported values. The official guide explains how those fields appear and how modifications can affect the references shown. [7]
Compare the extract with the exchange declarations and purchase file. Do not expect it to replace the deed, title certificate or payment reconciliation.
If a transaction is missing, investigate the transmission, identification and reporting route before creating another registration.
Special Cases That Need Attention
Deposits and Payments Before the Public Deed
Plan the treatment of deposits before the first transfer. A refundable reservation payment, a contractual advance and a payment into a construction project should not be classified solely because someone calls them a “deposit.”
Ask how each payment will be reported, what investment or rights it relates to and what procedure applies if the purchase does not close.
For preconstruction purchases, review the fiduciary agreement and release conditions. An initial investment in fiduciary rights may require a later review when the completed property is transferred.
Money Already Held in Colombia
Money in a Colombian account is not automatically disqualified from an investment transaction, but its history matters.
Review how it entered Colombia, how it was declared, the account’s classification and the buyer’s exchange residence. Then determine whether the purchase requires a direct registration, correction or another permitted procedure.
Avoid assuming that paying in pesos eliminates the need for exchange analysis.
Joint Purchases and Third-Party Payments
If two people will acquire the property, document their ownership percentages and respective funding.
If a spouse, company or other person sends money for the buyer, review the legal basis of that payment before transfer. It may involve a gift, loan, agency arrangement or another relationship that needs documentation.
Do not assume that paying the whole price automatically records the whole investment in the sender’s name.
Buying Through a Colombian SAS
A nonresident shareholder contributing equity to a Colombian SAS and the SAS purchasing a property are separate transactions.
The shareholder’s investment may be in the company’s shares, while the company owns the real estate. The investment destination should reflect that structure. If the funding is a shareholder loan, the debt rules require separate review.
Choose the ownership and funding structure before sending money, rather than attempting to change it after the transfer.
Example: A Purchase Paid in Two Installments
Assume a nonresident buyer agrees to purchase an apartment for COP 800 million, paying COP 80 million initially and COP 720 million at closing.
A practical payment plan would:
- Confirm the buyer’s exchange status and ownership structure.
- Complete property due diligence and negotiate the deposit protections.
- Have the intermediary confirm the reporting treatment of both transfers.
- Calculate each transfer using the agreed conversion and fees.
- Record and reconcile both payments.
- Complete the deed and property registration.
- Review the investment extract against the complete purchase file.
Keep closing expenses separately identified.
This is an illustration of transaction organization, not a visa threshold or an exchange-rate forecast.
What If the Funds Were Reported Incorrectly?
Collect the original transfer receipt, exchange declaration, account statements, purchase documents and investment extract.
Then determine what happened: an incorrect concept, identification error, missing transmission, incorrect destination or a different legal transaction may each require a different response.
The Banco de la República provides procedures for corrections, changes and annulments. The available route depends on the original record and the error. [8]
Do not file an additional registration merely to make the expected amount appear. That can create a duplicate without resolving the underlying issue.
How Much Does Foreign Investment Registration Cost?
The Banco de la República lists its direct investment registration service as having no charge. [9]
Other costs may include:
| Cost | What to confirm |
|---|---|
| International transfer charges | Sending, receiving and correspondent fees |
| Currency conversion | Quoted rate and spread |
| Legal assistance | Scope of review, coordination or correction |
| Supporting documents | Translations, certifications or powers, if needed |
| Property closing | Notarial, registration and applicable tax expenses |
An amount described as a “registration fee” should distinguish a professional service charge from an official charge.
What Happens When You Sell the Property?
A later sale can require cancellation or substitution of the registered investment, depending on the parties and structure.
2026 update: Decree 1044 of August 5, 2026 and the Banco de la República’s implementing circular of August 25 removed the previous six-month registration deadline for the covered substitutions and cancellations. These may now be registered at any time under the applicable procedures. [1][10]
The registration obligation remains. The reform also preserves separate formal tax obligations related to changes in ownership and indirect transfers.
Review the investment record, tax position and route for remitting proceeds before completing a sale.
Can the Investment Support a Colombian Investor Visa?
Potentially, but registration and visa approval are separate matters.
As of this article’s update, the M Investor Visa real estate route requires, among other conditions, property exclusively in the foreign applicant’s name with a minimum value equivalent to 350 Colombian legal monthly minimum wages at the application date, together with the required investment extract. [11]
A jointly owned property or property held by a Colombian company should therefore be assessed before relying on this route.
Do not assume the asking price, bank transfer or investment extract alone establishes eligibility.
Frequently Asked Questions
Is every international transfer automatically registered?
No. Automatic registration depends on a qualifying investment, the appropriate channel and correct investment information. A transfer processed as a personal remittance does not establish the same record.
Can I use an online money-transfer platform?
Confirm how the specific service channels the transaction, identifies the investor and supplies the investment information. The platform’s availability or ability to deliver pesos is not enough to answer those questions.
Do I need a separate Banco de la República certificate?
The official investment extract is obtained through the Foreign Exchange Information System. The Banco de la República states that it does not issue separate communications delivering those extracts. [8]
Can my lawyer handle the process?
An authorized representative can perform permitted procedures once the required representation is established in the system. Corporate investors must act through the appropriate individual representative. [12]
How long should I allow?
There is no single reliable timeline covering banking review, transfer, conversion, reporting and verification. Confirm each stage with the participating institutions and leave time to resolve questions before contractual deadlines.
